1. Legal Information

Access to, browsing and use of the website http://www.stratio.com (hereinafter, the “Website”) confers the status of user and implies full and unreserved acceptance of the present legal terms and conditions.

The Website is owned by STRATIO BIG DATA INC., Spanish Branch (hereinafter, “STRATIO”), with Tax Identification Number (CIF) W-4007784-D, and registered office for these purposes at Vía de las Dos Castillas 33, Ática 4 Building, 3rd Floor, 28224 Pozuelo de Alarcón (Madrid), Spain.

STRATIO is duly registered with the Madrid Commercial Registry under Volume 33,891, Page 22, Section 8, Sheet M-609883, Entry 1.

2. Access to and Use of the Website

Access to the Website is free of charge. Notwithstanding the foregoing, certain content, services or products offered through the Website may be subject to prior contracting and the payment of a fee, in which case the corresponding specific terms and conditions shall apply.

Users undertake to use the Website properly, diligently and in accordance with the law, morality, public order and these terms and conditions, and to refrain from carrying out any action that may, by way of example and without limitation: (i) cause damage or harm to STRATIO or third parties; (ii) affect the normal operation of the Website or its security systems; (iii) infringe intellectual or industrial property rights or other rights of third parties; or (iv) introduce, disseminate or use malicious software, viruses, unauthorized content or any other element capable of causing alterations to systems.

STRATIO reserves the right to limit, suspend or deny access to the Website, immediately and without prior notice, to users who breach these terms and conditions, without such action giving rise to any right to compensation.

3. User Liability

Users acknowledge and accept that they are solely responsible for their use of the Website, as well as for the content, data and activities carried out through it.

Accordingly, STRATIO does not guarantee and shall not be liable for any damages of any kind that may arise from actions carried out by users or by third parties not acting under its control, including, by way of example and without limitation, damages resulting from improper use of content, infringement of third-party rights or non-compliance with applicable regulations.

Notwithstanding the foregoing, STRATIO declares that it has adopted all necessary measures, within its capabilities and in accordance with the state of the art, to ensure the proper functioning of the Website and to minimize system errors, both from a technical and legal-organizational perspective.

Should users become aware of the existence of content that is unlawful, illegal, contrary to the law or that may infringe their own or third-party rights, they must notify STRATIO immediately through the means provided for this purpose, so that appropriate measures may be taken. STRATIO shall act with due diligence to review and, where appropriate, remove such content in accordance with applicable law.

4. STRATIO Liability

STRATIO uses its best efforts to ensure that the information and content offered through the Website are accurate, complete and duly updated. However, STRATIO does not guarantee nor shall it be liable for: (i) the absence of errors in the content; (ii) the availability, continuity or uninterrupted operation of the Website; or (iii) the absence of viruses, malicious programs or other harmful elements that may be introduced by third parties.

Consequently, STRATIO shall not be liable for any damages of any kind that may arise from: (i) the lack of availability, maintenance or proper functioning of the Website; (ii) improper, unlawful or negligent use of the Website by users; (iii) decisions taken by users based on the information contained on the Website; and (iv) content, services or information provided by third parties through links, external platforms or any other means outside STRATIO’s control.

STRATIO also reserves the right to temporarily suspend access to the Website, without prior notice, where necessary for maintenance, security, updating or improvement of services and technological infrastructures.

5. Intellectual and Industrial Property

All content comprising the Website, including, by way of example and without limitation, texts, images, designs, logos, graphics, videos, software, databases, navigation structures and other elements, are the property of STRATIO or, where applicable, of third parties who have authorized their use, and are protected by applicable intellectual and industrial property laws.

Access to, browsing or use of the Website does not, under any circumstances, imply the acquisition by users of any rights over such content, beyond those strictly necessary for the use of the Website in accordance with these terms and conditions. Any reproduction, copying, distribution, public communication, transformation or any other form of exploitation, in whole or in part, is expressly prohibited without the prior written authorization of STRATIO or the legitimate rights holder.

Likewise, the trademarks, trade names, signs, distinctive symbols and any other industrial property rights appearing on the Website belong to STRATIO or third parties, and access to the Website does not grant any rights over them.

Users undertake to respect at all times the intellectual and industrial property rights of STRATIO and third parties. Where users submit any content, information or material to STRATIO through the channels provided, they declare that they hold the necessary rights to do so, that such content does not infringe third-party rights, and that they assume full responsibility for any claims that may arise in this regard.

If users become aware of the existence of content that is unlawful, illegal, contrary to applicable regulations or that infringes intellectual or industrial property rights, they must notify STRATIO immediately through the contact details provided, so that appropriate measures may be taken.

Similarly, any third party who considers that any content on the Website infringes their rights may notify STRATIO, providing at least their identifying details, evidence of ownership of the allegedly infringed rights, a detailed description of the infringement and its specific location on the Website, as well as an express declaration that the use of such content has been carried out without their consent.

6. Hyperlinks

The Website may contain links to websites managed by third parties unrelated to STRATIO. Such links are provided solely for informational purposes, and STRATIO exercises no control over the content, services, products, policies or practices of such external websites.

Accordingly, STRATIO assumes no liability whatsoever for the content, information, services, operation, availability, lawfulness or results that may arise from access to such third-party websites, nor for the use made of them by users.

The existence of links on the Website does not imply any relationship, association, sponsorship, recommendation or endorsement by STRATIO of the owners, content or services of the linked websites.

Furthermore, the establishment of links from external websites to the Website must, in all cases, be made to the home page. The creation of frames, deep links, content alterations or any practice that may cause confusion regarding the ownership of the Website is expressly prohibited. STRATIO reserves the right to remove, limit or prohibit any link at any time, without prior notice.

7. Personal Data Protection

The processing of personal data derived from use of the Website shall be governed by the Privacy Policy, which is accessible at all times on the Website.

8. Cookies

The use of cookies is governed by the Cookies Policy, which details the types of cookies used, their purposes, the legal basis and the mechanisms for managing and configuring consent.

9. Validity of the Terms of Use

STRATIO may modify the terms of use of the Website at any time. The terms in force shall be those published at any given time in this section.

10. Invalidity and Ineffectiveness of Clauses

Should any of these clauses be declared null or ineffective, such nullity shall affect only that provision, and the remaining terms and conditions shall remain in full force and effect.

11. Applicable Law and Jurisdiction

Access to and use of the Website shall be governed by Spanish law. Any disputes that may arise from use of the Website shall be submitted to the Courts and Tribunals of Madrid, unless applicable law establishes a different mandatory jurisdiction.
